inap2 Design Document(s) Terms of Use and Conditions

These Terms and Conditions (hereinafter referred to as the "Terms") apply to the use of drawing data, renderings, specifications, and other related documents (hereinafter referred to as "inap2 Design Document(s)") sold and distributed through "inap2," an international platform for architectural projects operated by Easy Communications Inc. (hereinafter referred to as "the Company"). These Terms apply to all Persons who use the inap2 Design Document(s), regardless of how the documents were obtained, whether as originals or copies. All Persons who acquire inap2 Design Document(s) must comply with these Terms and respect the rights of both the designers and purchasers.

Additional specific terms may be established for inap2 Design Document(s). In such cases, users shall adhere to both these Terms and the specific terms. In the event of any inconsistency between these Terms and the specific terms, the specific terms shall take precedence. Furthermore, these Terms are written in English, and translations into other languages are provided for reference purposes only. In the event of any discrepancies between the English version of these Terms and any other language version, the English version shall prevail.

  • Utilization of Design Document(s) and Building License

    Although inap2 Design Document(s) are sold in various packages, it is not permissible to use or reference inap2 Design Document(s) from packages that do not include a building license to actually proceed with construction.

    A building license can be issued by purchasing a package that includes the building license. The building license grants permission to use the inap2 Design Document(s) but does not certify that the constructed building is built according to an official building license. Certification for these buildings shall be conducted using the inap2 Building Certificate as stipulated in these terms.

    • Usage of inap2 Design Document(s)

      The inap2 Design Document(s) are premised on architectural firms, architects, or construction companies that authorized to conduct design work under the laws of the construction site (hereinafter referred to as "Local Architects"), to integrate the environmental conditions, building codes, structural laws at the construction site, locally applicable construction methods, materials, and any other client’s preferences to conduct the localization works and create the final design drawings and construction drawings (hereinafter referred to as "Final Drawings").

      The data included in the inap2 Design Document(s) consists of images, PDFs, as well as 2D/3D data for design drawings. Specialized software is required for viewing and editing this data, and users shall prepare this software on their own. Please refer to the description of each package for the types of data included.

    • Scope of Use for inap2 Design Document(s) with a Building License

      The holder of the building license is granted the right to use the inap2 Design Document(s) for the construction of only one building as defined in the inap2 Design Document(s) per 1 building license. This building license also includes the right to display inap2 Design Document(s), such as renderings, in portfolios for the purpose of attracting investment for the project.

      If multiple buildings are to be constructed based on the same inap2 Design Document(s) or if the inap2 Design Document(s) are to be used in the portfolios of multiple projects, building licenses must be purchased for the same number of buildings or projects as intended.

    • Scope of Use for inap2 Design Document(s) without a Building License

      The use of inap2 Design Document(s) from packages that do not include a building license is limited to purposes such as project consideration, requesting estimates for design modifications from architectural firms, requesting construction cost estimates from contractors, or for personal appreciation by the purchaser.

    • Copyright

      The copyright of inap2 Design Document(s) belongs to the designer, and purchasers are only granted usage rights in accordance with these Terms. Regarding the Final Drawings created based on design modification to the inap2 Design Document(s) , the copyright of the modified portions shall belong to the local architect who conducted the changes.

    • Reproduction and Distribution of inap2 Design Document(s)

      Officially purchased inap2 Design Document(s) may be reproduced and distributed only to parties involved in the same project, and only to the extent necessary for review, estimation, building permits applications, design modifications, and construction. However, the distributor must share these Terms with the recipients and obtain written or electronic confirmation of their consent to the Terms, along with the recipient’s personal information (corporate or individual name, contact person name, address, and phone number). If no such records exist, the distributor assumes full responsibility for any use by the recipient.

    • Modifications to inap2 Design Document(s)

      Purchased inap2 Design Document(s) may be freely modified to align with the environmental conditions, regulations, and the preferences of the client at the construction site. However, any design modifications must be carried out in compliance with applicable laws and regulations in the construction site under the responsibility of the Local Architect.

      Furthermore, it may be possible to request customization of the inap2 design documents through inap2 by the Original Designer (or the relevant architectural design firm). Even in such cases, the design documents delivered by the Original Designer shall be limited to the basic design documents, and the creation of the final design documents shall be carried out under the responsibility of the Local Architect, ensuring compliance with the laws and regulations of the construction site.

    • Sales Restrictions

      Unless otherwise specified, there shall be no restrictions on the number of inap2 Design Document(s) sold or the number of building licenses issued.

    • Cancellations and Returns

      inap2 Design Document(s) cannot be canceled or returned after purchase, except in the case of defects as outlined below.

      In the case of defects:

      If the inap2 Design Document(s) contain defects that do not fall under the disclaimers defined in these Terms, the purchaser must contact inap2 within two weeks of purchasing the package. If inap2 acknowledges the defect, inap2 will promptly request the designer to produce a revised version of the inap2 Design Document(s), which will be provided to the purchaser at no additional cost. If a revised version cannot be provided, a refund for the purchase price of the package will be issued upon request. In this case, the building license included in the package will become invalid.

  • inap2 Building Certificate

    A certified building license will be issued for buildings constructed with an official building license, known as the inap2 Building Certificate (hereinafter referred to as the “Certificate”). The Certificate includes signatures from both the designer and a representative of inap2, along with information such as the building's location and the building license key.

    • Issuance and Reissuance of the Certificate

      To apply for a Certificate, the following documents must be submitted after the completion of the building, following the method separately defined by inap2. While it is possible to reissue a Certificate following the prescribed procedures, changes to the building's location information are not permitted for the same building license key.

      1. Photos of the completed building
      2. Building location information
      3. Information on the construction company, Local Architect, and their respective representatives
      4. Information about the client
    • Usage and Transfer of the Certificate

      The Certificate can be presented when introducing, renting, or selling the building. Additionally, the Certificate may be transferred to the purchaser of the building.

    • Types of Certificates

      The type of Certificate issued will vary depending on the level of fidelity to the original design’s aesthetic value. The decision on the type of Certificate issued will be made by the designer and inap2. It should be noted that the type of Certificate does not guarantee or evaluate the quality or functionality of the building.

      1. Master Architect Certification (Blue)

        This certificate is issued for buildings constructed with an official inap2 building license, where the original design and the designer’s aesthetic value have been highly realized, either through design modifications made by the designer (or their firm) or under their direct supervision. The building owner is permitted to use the name of the inap2 Design Document(s)’ designer as the "Master Architect" when introducing the building.

      2. Concept Designer Certification (Green)

        This certificate is issued for buildings with an official inap2 building license, where many design modifications have been made from the original design, but the original concept and the designer’s aesthetic value are still respected. The building owner is permitted to use the name of the inap2 Design Document(s)’ designer as the "Concept Designer" when introducing the building.

      3. Certified Homage Certification (Orange)

        This certificate is issued for buildings with an official inap2 building license, where significant design modifications have been made, and the final design differs from the original aesthetic value. However, the building still draws some inspiration from the original design. The building owner is permitted to use the name of the inap2 Design Document(s)’ original designer alongside the Local Architect responsible for the design modifications when introducing the building.

  • Local Architect

    The Local Architect, who modifies the inap2 Design Document(s) to suit the environmental conditions, building codes, structural laws, locally available construction methods and materials, and any client preferences at the construction site, must adhere to the following guidelines when using inap2 Design Document(s).

    • Compliance with Laws

      The Local Architect must be authorized to conduct design work according to the laws of the construction site and must ensure that the Final Drawings based on the inap2 Design Document(s) comply with local regulations.

    • Safety First

      The responsibility for ensuring the safety of the Final Drawings and the building lies with the Local Architect. The Local Architect in charge of construction supervision must ensure that the construction is safe and compliant with local regulations. Additionally, the Local Architect must make necessary design modifications to create a safe and comfortable space, considering factors such as local weather, soil conditions, security, and the surrounding environment.

    • Structural and Design Modifications

      Since safety standards and construction methods vary greatly depending on the construction site, the Local Architect must select appropriate methods and conduct structural calculations to ensure safety.

      Necessary design modifications should be made according to the chosen structure, construction methods, materials, and equipment, and the Final Drawings should be completed accordingly.

    • Respect for the Original Design

      In the absence of specific requests from the client, the Local Architect shall respect the designer's aesthetic value and concept and endeavor to make design modifications that align with and extend these original ideas.

  • Prohibited Acts and Compensation for Damages

    • Unauthorized Use of inap2 Design Document(s) and Building License

      If any of the following prohibited acts are identified, the user of inap2 Design Document(s), regardless of negligence, shall compensate inap2 and the rights holders of the relevant inap2 Design Document(s) for any and all damages incurred. In the event of unauthorized or improper use of the inap2 Design Document(s) or building license, the user agrees to pay a usage fee equivalent to twice the package price, including the building license that should have been purchased (this does not imply permission for unauthorized or improper use). Additionally, the user agrees to pay inap2 compensation for damages no less than the lower limit amount of damages suffered by inap2,and the rights holders of the inap2 Design Document(s), including but not limited to litigation costs and attorney fees.

      1. Using or referencing inap2 Design Document(s) to construct a building without purchasing a package that includes a building license.
      2. Using inap2 Design Document(s), such as renderings, in portfolios for the purpose of attracting project investments without purchasing a package that includes a building license.
      3. Reproducing, distributing, or making inap2 Design Document(s) available to third parties beyond the scope permitted by these Terms.
      4. Reselling inap2 Design Document(s), in whole or in part.
      5. Using or adapting inap2 Design Document(s), in whole or in part, in other copyrighted works, whether for-profit or non-profit.
      6. Transferring building licenses and their associated rights to others.
      7. Using the inap2 Design Document(s) in a manner that exceeds the rights granted by the inap2 Design Document(s) under these Terms.
    • Other Prohibited Actions

      If any actions prohibited by these Terms are identified, inap2 may demand that the user make improvements. If the improvements are not recognized or inap2 determines that the actions are extremely malicious, inap2 reserves the right to refuse the use of purchased inap2 Design Document(s) and building licenses without prior notice, and the user agrees to comply with this decision.

  • Disclaimer

    • Regarding inap2 Design Document(s)

      In principle, inap2 Design Document(s) are premised on providing blueprints and specifications for buildings that can be constructed. However, since these documents are concept designs data premised on further development by Local Architects who will create the final drawings, inap2 and the designers bear no responsibility for the following disclaimers. Purchasers and users shall not hold inap2 or the designers liable for any damages resulting from these disclaimers.

      In particular, when purchasing higher-priced packages that include building licenses, it is recommended to first purchase a more affordable package for review and consult a Local Architect to assess the feasibility of the project at the construction site, as well as to obtain rough estimates for design modifications and construction costs.

      1. Completeness

        inap2 Design Document(s) contain basic information (such as dimensions and specifications) intended to help Local Architects understand the designer's concepts and intentions when creating the final drawings. inap2 Design Document(s) alone do not guarantee the completeness required for construction.

      2. Alignment

        inap2 Design Document(s) do not guarantee complete alignment, and there may be portions lacking full coherency. In such cases, it is the responsibility of the Local Architect to make adjustments when creating the final drawings.

      3. Comfort

        inap2 Design Document(s) do not guarantee comfort, regardless of the construction site. Optimal solutions for comfort will vary based on factors such as weather, soil conditions, security, and the surrounding environment. Local Architects are responsible for adjusting these elements appropriately when creating the final drawings.

      4. Legality

        inap2 Design Document(s) do not guarantee compliance with local building regulations. Typically, each country and region has its own unique building laws and ordinances. It is the responsibility of the Local Architect to verify the legal compliance of the construction site and to assess what design modifications are necessary to ensure conformity.

        Compliance with laws and regulations regarding the final drawings, various building license applications, construction, and construction supervision is the sole responsibility of the Local Architect.

      5. Reproducibility

        While inap2 Design Document(s) are of exceptionally high quality, provided by experienced architects with numerous construction achievements, they do not guarantee exact reproduction as depicted in the renderings in terms of construction site. Significant design modifications may be necessary due to building regulations, available construction methods, materials, and equipment at the site, and the quality of construction may reduce the level of reproducibility.

      6. Feasibility

        inap2 Design Document(s) do not guarantee feasibility at the purchaser's construction site. There may be cases where the project is unfeasible due to local building regulations, available construction methods and materials, equipment, weather, soil conditions, security, or the surrounding environment.

      7. Safety

        inap2 Design Document(s) do not guarantee any safety regarding the inap2 Design Document(s), the building, or the construction process. The Local Architect is responsible for ensuring safety in the final drawings, construction, and the completed building.

        In particular, with respect to structure, since safety standards and construction methods vary significantly depending on the construction site, it is the Local Architect’s responsibility to select appropriate methods, perform structural calculations, and ensure safety.

    • Purchase of inap2 Design Document(s)

      For inap2 Design Document(s) with defects as defined in these Terms, inap2 and the designers of the documents shall bear no liability for damages due to delays caused by the creation of revised versions. Furthermore, inap2 and the designers of the inap2 Design Document(s) shall not be liable for any damages exceeding the refund of the purchase price of the package in the event that a revised version cannot be provided.

    • Issuance of the inap2 Building Certificate

      Applicants agree to respect the decision of the designer and inap2 regarding the type of certificate issued and shall not raise any objections or complaints about the decision.

      In addition, inap2 and the designer shall bear no responsibility for any damage caused by the type of certificate.

  • General Conditions

    All matters related to these Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Japan, without affecting the choice or inconsistency of applicable laws or regulations. Users agree to submit to the jurisdiction of the courts in Japan for the resolution of all disputes arising out of or in connection with these Terms and/or the use of inap2 Design Document(s). However, inap2 reserves the right to bring legal action for violations of these Terms in the user’s country of residence or any other relevant country. Users waive all objections regarding the exercise of jurisdiction by such courts and courtrooms.

    Users acknowledge that these Terms may be revised from time to time. Any revisions will not be applied retroactively. The latest version of the Terms governing the handling of inap2 Design Document(s) will always be available at https://www.inap2.com/mu-en/collections/terms/. These Terms may be modified at the discretion of the Company without prior notice to users. By continuing to use inap2 Design Document(s) after such changes, the user is deemed to have agreed to the revised Terms, and the modified Terms shall apply.

    If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be limited or nullified to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect. The Company’s failure to enforce any rights or provisions of these Terms shall not be considered a waiver of such rights or provisions.
